A state appeals court in New Jersey says if you text a driver who gets in a crash, you could be held liable.
The issue was raised by a lawyer whose clients both lost their left legs when a teenager hit their motorcycle in 2009.
Kyle Best, then 19, had just texted his girlfriend when he crossed the center-line, and hit the couple head on.
The couple settled their lawsuit against Best, but also sued his girlfriend.
The court said... "when a texter knows that the intended recipient is driving and is likely to read the text message while driving, the texter has a duty to users of the public roads to refrain from sending the driver a text at that time."
The court says the sender is taking a foreseeable risk.
Two of the three judges agreed in their opinion.
Still, the lawsuit against the girlfriend was dismissed because there was no evidence that the girlfriend knew that her boyfriend was driving at the time.
