ESCAMBIA COUNTY - We begin with a breaking news update on a murder investigation.

Four weeks ago, Jared Ortiz was at poker night at the Oakcrest Lounge on Fairfield Drive.

When he was shot in the head during a robbery.

Two men was arrested for the crime and family and friends thought the case was closed.

But, now one of those men will not stand trial.

Channel Three's Laurie Bernstein joins us live from the lounge with the details.

David Gilchrist was the second suspect arrested in the murder of Jared Ortiz and deputies even said they thought he was the one who fired the fatal shot.

But now people here at the oakcrest lounge are shocked to hear the 20-year-old man is a free man after all charges against him have been dropped.

The state attorney's office tells us that Gilchrist was arrested based on a statement given by the other suspect charged in the crime, Brandon Davis.

He said Gilchrist was at the bar with him the night of the murder.

But Davis has since recanted that statement saying Gilchrist was not involved in the crime.

And so with no there evidence against Gilchrist, prosecutors decided to drop all charges against the 20 year old.

But that means there is still one suspect out there responsible for Ortiz's murder.

And that thought does not sit well with people here at the Oakcrest bar.

We talked with one woman who wanted to remain anonymous.

"I'm scared upset, very upset. Mad. That if this guy Gilchirst didn't do this then it scares me."

Brandon Davis is still charged in the murder.

He will be appearing in court tomorrow morning at nine am for first degree felony murder charges.
