SPANISH FORT, AL - The family of murder victim Bobby Wilson is speaking out about the not guilty verdict of the man they believe murdered him.

The 71 year old was beaten and robbed at his service station in Spanish Fort in August of 2007.

In January, Leslie Eric Buzbee was arrested for the crime.

He went to trial on capital murder charges in May and August both times a mistrial was called.

Then last week, Buzbee was found "not guilty".

Channel Three's Jake Peterson joins us with more on what the family believes happened that Summer morning.

Bob, Wilson's daughter sat through more than six months of testimony.

She still believes the prosecution had the right man.

"My dad was a good man and he didn't deserve that."

Wilson's daughter, Tracey Goens, believes the prosecution's theory that Eric Buzbee robbed her father for drug money.

"After sitting there for a month and all these hearing and trials, and I do think they had the right person you know I listened to all the evidence."

But that evidence wasn't enough to convince a jury.

All of it was circumstantial like a cell phone tower placing Buzbee near the scene of the crime.

"That's the problem there wasn't one glaring piece of evidence it was all the pieces coming together and that's sometimes difficult for a jury to see."

District Attorney Judy Newcomb says the murder of Bobby Wilson is case closed for now.

"Our evidence was toward to Mr. Buzbee and right now we have no evidence that points towards anybody else."

Family members say the prosecution should have worked harder.

Goens faults Newcomb for not prosecuting the case herself.

"With the complexity of this case that she needed to be there to help assist this case I think that hurt us."

"I did try the case my office tried the case I was involved in the prosecution of the case."

The Wilson family is moving on, but they don't believe justice was served.

"It wasn't but I believe we all have to answer to a high justice and I really prayed about because I don't want to become bitter and angry I want to use this in a positive way my dad was a strong person and sometimes out of bad things good things happen."

Eric Buzbee has maintained his innocence the entire time.

He was not available for comment on this story.
